1 Eligibility

4 Your content

You retain ownership of documents, messages, and other materials you submit to the Service ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive license to host, store, process, display, and use Your Content solely to operate, provide, and improve the Service — including AI-powered features such as tutoring, document analysis, quizzes, and study plans.

You represent that you have the rights necessary to submit Your Content and that doing so does not violate any third-party rights or applicable law. You are solely responsible for Your Content.

5 AI-generated output

The Service uses artificial intelligence to generate responses, summaries, quizzes, and other learning materials. AI output may be inaccurate, incomplete, or inappropriate for your specific situation. You should verify important information independently and not rely on AI output as professional, medical, legal, or financial advice.

6 Subscriptions, tokens, and payments

Some features require a paid subscription or use of in-platform tokens. Prices, plan limits, and billing terms are shown at the time of purchase. Unless otherwise stated, subscriptions renew automatically until cancelled. You are responsible for applicable taxes.

Refunds, if any, are handled according to the refund policy presented at checkout or required by applicable consumer protection law. We may change pricing or plan features with reasonable notice where required.

7 Intellectual property

The Service, including its software, design, branding, and documentation (excluding Your Content), is owned by CapyIT AI or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding except as permitted by law or with our prior written consent.

8 Third-party services

The Service may integrate with third-party services (such as Google sign-in, email delivery, cloud storage, and AI providers). Your use of those services may be subject to their separate terms and policies. We are not responsible for third-party services we do not control.

9 Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CapyIT AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

11 Indemnification

You agree to defend, indemnify, and hold harmless CapyIT AI and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms.

12 Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

13 Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Material changes may also be communicated through the Service or by email where appropriate. Continued use after changes become effective constitutes acceptance of the updated Terms.

14 Governing law and disputes

These Terms are governed by the laws applicable in the jurisdiction where CapyIT AI is established, without regard to conflict-of-law principles. Where permitted by law, disputes will be resolved in the courts of that jurisdiction, unless mandatory consumer protection rules in your country require otherwise.
